Abstract
This chapter outlines the historical development of the Indonesian Constitution and discusses how well it has accommodated human rights. It also discusses the literature on the relationship between politics, law, and democratic regression. It specifically discusses the role of Constitutional Court, the so-called guardian of the constitution. From there, the chapter focuses mainly on the constitutional right to freedom of expression. This focus is chosen due to the strong link between press freedom, democracy, and the rule of law. It analyses various judgements from the Constitutional Court, as well as from general courts and administrative courts.
