Abstract

Objective: This research aims to analyze regulations related to houses above sea water which have not been regulated in several laws and regulations, especially regarding the provision of types of rights for people who have houses above sea water because land covered by sea water is also considered as land in general based on PP No. 18 of 2021 Theoretical Framework: House or place to live is essentially a basic need for people apart from clothing, food, education and health. There are types of houses in Indonesia that are located above sea water, with constructions that use poles as supports which are embedded in land covered by sea water Method: This research is legal research, the approaches used in this research include a statute approach and a conceptual approach Results and Discussion: The result of this research is that the right to certainty of ownership of houses above sea water can be given to the people in order to fulfill one of the objectives of the enactment of the UUPA, namely laying the foundations for providing legal certainty regarding land rights for the people as a whole Research Implications: This research has implications for the development of science, especially in the development of regulations related to agrarian law Originality/Value: ownership rights to houses above sea water should be given to ensure legal certainty for people who own houses above sea water, namely by granting right to build to the community for ownership of houses above sea water where the building use rights will be separate from the land. which is covered by sea water.
