Abstract
Each country has a constitution which generally used as a guide to run the government-wheels. In Indonesia constitution which applying a presidential government system, it uses the concept of separation of power between branches in order to implement the checks and balances principles. One of those is managing the state finances as outlined in the form of State Budget (APBN) every year. The 1945 Constitution of The Republic of Indonesia grants authority to the President as an executive body in proposing the State Budget Bill (RAPBN) as well as providing an authority to the House of Representative (DPR) as a legislative body to approve the State Budget Bill submitted by the President. Approval of the House of Representatives on the RAPBN is considered as crucial in the establishment and confirmation of the APBN thus this article will discuss the problematic in case of rejection of RAPBN by the House of Representatives as well as the attempt that can be taken by the executive in solving the problem. The research method uses normative legal research and the conclusion of this paper is the relationship between the government and the DPR in the form of checking and balancing relations and the government can take the option to realize the State Budget Law in the event of an improvement in the State Budget Bill by the DPR.
